End User Licence Agreement
1. Who this licence is between
The Licensed Applications — Public Safety Strong (including its Dispatcher Strong, LEO Strong, Fire Strong and EMS Strong professions) and Reset — are licensed, not sold, to you by Chaos Innovations LLC, a Virginia limited liability company ("Licensor", "we", "us"), for use only under this End User Licence Agreement ("Licence").
By downloading, installing or using a Licensed Application — whether directly from chaosinnovations.com or through an app store such as Google Play or the Apple App Store (each a "Store") — you agree to this Licence. If you do not agree, do not install or use it. We reserve all rights not expressly granted to you.
The Stores are not parties to this Licence and have no obligation for the Licensed Applications, including their warranty, liability, maintenance or support. Chaos Innovations LLC, not the Store, is solely responsible for the Licensed Applications and their content. This Licence does not provide usage rules that conflict with the Google Play Terms of Service or the Apple Media Services Terms and Conditions ("Usage Rules"); if it ever did, the Usage Rules would prevail to that extent.
2. The applications
The Licensed Applications are private, self-supportive wellness tools for Android (and, if released, iOS) devices. They provide optional tools and educational content for physical wellness, movement, breathing and relaxation, reflection, journaling, preparedness and voluntary personal tracking. All data you enter is stored encrypted on your device; the directly downloaded builds contain no network permission at all.
They are not medical devices, not emergency services, and not systems of record. They are not designed to comply with HIPAA, CJIS, FISMA or other industry-specific regulations, so you may not use them to store or process information those regulations govern.
3. Scope of licence
3.1 We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use each Licensed Application on devices you own or control, and as permitted by the Usage Rules, including family sharing where the Store supports it.
3.2 This Licence also governs any update we provide that replaces, repairs or supplements a Licensed Application, unless that update comes with its own licence.
3.3 You may not share, sell, rent, lend, lease or otherwise redistribute a Licensed Application, or make it available over a network for use by several devices or people at once.
3.4 You may not reverse engineer, decompile, disassemble, translate, modify, adapt, combine or create derivative works of a Licensed Application, or attempt to derive its source code, except where and only to the extent that applicable law expressly permits it notwithstanding this restriction.
3.5 You may not remove or alter any copyright, trademark or other notice, or circumvent any licence check, trial period or technical limit.
3.6 If you sell or give away a device, remove the Licensed Applications from it first. Doing so also removes your data, which cannot be recovered afterwards.
3.7 Breach of this section, or an attempt to breach it, ends your Licence and may expose you to claims for damages.
4. Technical requirements
The Licensed Applications require Android 8.0 or later and a current version of Android System WebView. We try to keep them working with new versions of the operating system and new hardware, but you are not entitled to any particular update. It is your responsibility to confirm your device meets these requirements.
5. Maintenance and support
We are solely responsible for any maintenance and support of the Licensed Applications. You can reach us at support@chaosinnovations.com. The Stores have no obligation to provide maintenance or support.
6. Your data
We do not collect, receive or have access to what you enter in a Licensed Application. It is encrypted on your device with a key that cannot leave it. See the Privacy Policy. Because we never hold a copy, you are responsible for keeping your device secure and for keeping your own copies of anything you cannot afford to lose; the export feature produces a record of your entries but cannot currently restore them.
7. Warranty
7.1 We warrant that, at the time you download it, a Licensed Application obtained from us or a Store is free of spyware, trojan horses, viruses and other malware, and that it works substantially as described.
7.2 This warranty does not cover a Licensed Application that has been modified, obtained from anywhere other than chaosinnovations.com or a Store, installed on an unsupported device, or affected by anything outside our reasonable control.
7.3 If you find a defect, please tell us promptly at support@chaosinnovations.com. If we confirm it, we may fix it or provide a replacement build.
7.4 If a Licensed Application obtained from a Store fails to conform to any applicable warranty, you may notify the Store, which may refund the purchase price in line with its policies. To the maximum extent permitted by law, the Store has no other warranty obligation with respect to the Licensed Application.
7.5 Except as stated in this section, and to the fullest extent the law allows, the Licensed Applications are provided "as is" and "as available", as set out in section 12 of our Terms of Use.
8. Liability
8.1 Our liability is limited as set out in section 13 of our Terms of Use. That limit does not apply to death or personal injury caused by our negligence where the law does not allow it to be limited.
8.2 We are not responsible for any damage caused by a breach of section 3 of this Licence, or for data lost because a device was lost, reset, wiped or damaged, or because the app was uninstalled.
8.3 We are not responsible for any reliance on the content of a Licensed Application as medical, psychological, legal, occupational or other professional advice. It provides none.
9. Product claims
You and we acknowledge that Chaos Innovations LLC, and not any Store, is responsible for addressing any claim by you or a third party relating to a Licensed Application or your possession or use of it, including (i) product liability claims, (ii) any claim that it fails to conform to an applicable legal or regulatory requirement, and (iii) claims under consumer protection, privacy or similar laws.
10. Intellectual property claims
If a third party claims that a Licensed Application, or your possession and use of it, infringes that party's intellectual property rights, Chaos Innovations LLC, and not the Store, is solely responsible for investigating, defending, settling and discharging that claim.
11. Legal compliance
You represent and warrant that you are not located in a country subject to a US government embargo or designated by the US government as a "terrorist supporting" country, and that you are not listed on any US government list of prohibited or restricted parties.
12. Termination
This Licence lasts until you or we end it. It ends automatically, without notice, if you fail to comply with any of its terms. When it ends you must stop using and uninstall the Licensed Applications and destroy any copies of them.
13. Third-party terms and beneficiaries
You must comply with any applicable third-party terms, such as your wireless carrier's and the Store's, when using a Licensed Application. Google and Apple, and their subsidiaries, are third-party beneficiaries of this Licence, and upon your acceptance of it they will have the right (and will be deemed to have accepted the right) to enforce it against you as third-party beneficiaries.
14. Governing law and disputes
This Licence is governed by the laws of the Commonwealth of Virginia, excluding its conflict-of-laws rules. Disputes are resolved as set out in section 18 of our Terms of Use, including informal resolution first and individual arbitration, with the right to opt out.
15. Miscellaneous
If any term of this Licence is or becomes invalid, the rest remains in effect, and the invalid term is replaced by a valid one that achieves its purpose as closely as possible. Changes to this Licence are made as described in section 15 of our Terms of Use.
